8/1/2015 – According to a published article by Business Insider, the FBI has subpoenaed an affidavit containing alleged texts between former Subway spokesman Jared Fogle and a former female Subway franchisee. It is alleged that those text messages have Fogle admitting to paying a 16-year-old female $100 for sex and trying to talk another woman into prostituting herself and possibly having a threesome with Fogle and a minor.

The woman, whose name has not been made public, allegedly received the texts from Fogle when the two were engaged in a romantic relationship. The woman is also described as a former Subway franchisee.

The woman’s attorney claims his client notified Subway management at the time, but Subway did nothing about it. Subway claims to have no record of the woman’s complaint or concerns.

The woman then had her attorney extract the text messages and archive the content in affidavit form.

The woman’s attorney claims that the FBI subpoenaed his law office for the text message conversations in question.

Business Insider claims they have seen the content of the texts, verified the authenticity of the affidavit and claims the texts contain the following;

  1. Repeated attempts by Fogle to convince the female Franchisee to prostitute herself to other men on Craigslist.
  2. Fogle tells the woman she can make about $500 per ‘John.’
  3. Fogle asks if he can watch her have sex with other men.
  4. Fogle tries repeatedly to convince the female franchisee to set up a meeting between him and her underage female cousin. “When can we find a time for me to talk to your cousin?
  5. Fogle asks the female franchisee “tell me what u think about when u think of the three of us all together???
  6. Fogle recounts a time where he allegedly paid a 16-year old girl $100 for sex. “It was amazing!!!!

The conversations with the female franchisee reportedly occurred from Jan. 2008 until June 2008.

Federal authorities will not confirm or deny an ongoing investigation into Fogle.

Subway suspended its relationship with Fogle on July 7 after federal and state authorities raided his Indiana home. Subway has since removed all evidence of Fogle’s existence from their website and stores.

In April, Russell Taylor, previously the executive director of Fogle’s charitable foundation – Jared’s Foundation –  was arrested on child-pornograhy charges just months before Fogle’s home was searched by authorities. Taylor was fired immediately following the raid of his home. Investigators say they found hundreds of videos of child pornography in Taylor’s possession.
